By accessing or using FormPop ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Description of Service

FormPop is a web-based service that allows users to create, customize, and share forms and quizzes through ChatGPT and our web interface. The Service provides:

• Form and quiz creation tools
• Hosted form pages with shareable URLs
• Submission collection and management
• Data export capabilities
• Webhook integrations
• Email notifications

User Accounts and Authentication

To access certain features of the Service, you may be required to authenticate using:

• Email-based magic link authentication
• Session cookies for maintaining authentication state

You are responsible for maintaining the confidentiality of your account access and for all activities that occur under your account.

Acceptable Use

You agree to use FormPop only for lawful purposes. You may not use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Collect sensitive personal information without proper consent and compliance with applicable laws
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems

• Impersonate others or misrepresent your affiliation

Content and Data

Your Content

You retain all rights to the content you create using FormPop, including form configurations and submission data. By using the Service, you grant FormPop a license to host, store, and display your content solely for the purpose of providing the Service.

User Responsibility

You are solely responsible for:

• The content of forms you create
• Compliance with data protection laws (GDPR, CCPA, etc.) when collecting user data
• Obtaining proper consent from form respondents
• The accuracy and legality of data you collect

Service Limitations

Form Expiration

Forms expire automatically after their set expiration date (default: 30 days, maximum: 90 days). Expired forms and their submissions may be deleted.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability.

Storage Limits

We reserve the right to impose reasonable limits on storage, submission counts, or other service usage to ensure fair use and system stability.

Intellectual Property

The Service, including its design, code, features, and trademarks, is owned by FormPop and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

Termination

We reserve the right to suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Any reason we deem necessary to protect the Service or other users

You may terminate your use of the Service at any time by deleting your forms and ceasing to use the platform.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties that the Service will be uninterrupted or error-free

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMPOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service
• Any data breaches or security incidents

Indemnification

You agree to indemnify and hold harmless FormPop from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create or collect using the Service

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
